RELEASE AND ENTRY FORM 1. AUTHORSHIP: I/we am/are the author(s) of
the screenplay which I/we have submitted to the Applause Screenwriting
Competition (ASC).
2. OWNERSHIP AND SUBMISSION CRITERIA: I/we am/are the sole and exclusive
owners(s) of all rights thereto and there are no disputes regarding
ownership of the submission. I/we have full authority to submit
the screenplay to the ASC screenwriting competition. I/we attest
to the fact that my/our screenplay has never been optioned by a
producer or other production entity for any dollar amount. I/we
request that you read and evaluate my/our screenplay, agree to pay
the entry fee that is enclosed with this contract and acknowledge
that my/our submission of this written material is voluntary. Screenplays
that are optioned or purchased after entry will be disqualified
from competition and entry fees not refunded.
3. DEFAMATION: I/we guarantee the submitted screenplay does not
invade or defame the rights of any person, living or dead and I/we
fully indemnify ASC against any claim made for such invasion, defamation
or other violations of law.
4. PRIZES: I/we fully understand the prize specifications. I/we
will be notified by either e-mail, telephone, or postal service.
Any and all expenses and costs derived from travel in order to utilize
said prizes will be incurred by myself/ourselves. ASC is not responsible
for travel arrangements, hotel or any form housing accommodations
and any associated expenses. Any and all taxes associated with the
prize winnings are the sole responsibility of myself/ourselves and
not by ASC.
5. RULES AND GUIDELINES: I/we understand the contest rules
and guidelines and agree to adhere to them accordingly or forfeit
my/our entry fee and chance to participate in the contest.
6. LIMITATION OF LIABILITY: I/we fully understand the following
stipulations: ASC contains facts, views, opinions, statements and
recommendations of third party individuals and organizations. ASC
does not represent or endorse the accuracy or reliability of any
opinions, statements, or any other information displayed, uploaded
or distributed through the ASC website. I/we acknowledge that any
reliance upon any such opinion, statement or information shall be
at my sole risk. ASC makes no warranty regarding any content, services
or products provided through or in connection with this website.
ASC expressly disclaims any and all warranties, expressed or implied,
including, without limitation: (a) any warranties as to the availability
and accuracy of content or information, products or services which
are a part of the ASC website; and (b) warranties of fitness for
a particular purpose, or merchantability or against infringement.
In no event will ASC, its affiliates, licensers, employees, agents
or contractors be liable to you for any damages or losses, including
without limitation indirect, consequential, special, incidental,
or punitive damages resulting from or caused by the ASC website,
its content or any errors or omissions in its content, even if advised
of the possibility of such damages. Any liability of ASC, its affiliates,
licensers, employees, agents or contractors, including without limitation
any liability for damages caused or allegedly caused by any failure
of performance, error, omission, interruption, deletion, defect,
delay in operation or transmission, computer virus, communications
line failure, theft or destruction or unauthorized access to alteration
of, or use of records, whether for breach of contract, tortuous
behavior, negligence, or any other cause of action shall be strictly
limited to the amount paid ASC by or on behalf of you in 12 months
prior to the claimed injury or damage. Notice of termination or
disqualification to ASC is the only remedy afforded members dissatisfied
with the content, or changes in policies, terms of this agreement
or services fees relating to the ASC website.
7. INDEMNIFICATION: I/we agree to hold ASC, its affiliated companies,
employees, readers, agents, judges and third-party information providers
harmless from and defend them against all claims, demands, losses,
costs, damages, judgments, liabilities and expenses (including attorneys
fees) arising out of or in connection with any and all claims, whether
or not groundless, based on my/our screenplay submitted to ASC or
on any screenplay developed out of such submissions. I/we also will
not assert against ASC and said related parties any claim or action
based on plagiarism, infringement, confidential relationship, implied
contract, idea theft or any other theory arising out of ASC's review
of the submitted materials or any alleged use by the related parties
of the submitted materials. If, notwithstanding my/our release above,
I/we should bring any action against ASC or its related parties
arising from this competition, litigation will take place in Placer
County, California and if I/we am/are unsuccessful in such action,
I/we agree to pay ASC and/or its related parties all of their costs
and expenses in defending such an action, along with any penalties
a judge may award.
8. ACCESS TO IDEAS: I/we recognize that ASC and its affiliates have
wide access to ideas, stories and other literary materials and that
new ideas are constantly being submitted to you. I/we also recognize
that many ideas and stories are similar and often different stories
and ideas relate to one or more underlying themes.
9. ASC will send the 1st, 2nd and 3rd prize winning
scripts to the firms listed on the ASC website. Winners will be
responsible for sending copies to the other firms if so desired.
10. SUBMITTED MATERIAL: I/we have retained at least one copy of
the submitted material and I/we understand that the submitted copies
will not be returned to me/us.
11. PUBLICITY. ASC semifinalist and finalist information may be
shared with select parties. ASC winners will freely permit ASC to
use their name and/or likeness in post-competition publicity along
with summary and logline information about the winning screenplays,
prizes won, author(s)' bio and any other information deemed appropriate.
